====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Siwan Muffasil P.S. Case No.479 of 2017 registered under Sections 272, 273, 308 and 420 of the Indian Penal Code besides Sections 41(1), 30(a)(b)(c) and 35 of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about doing the business of illicit country made liquor by this petitioner and his son, the house of the petitioner was searched by the police and in course of search, 375 bottles, each containing 200 ml. country made liquor, were recovered from the straw house of the petitioner.

Patna High Court Cr.Misc. No.17592 of 2018(2) dt.29-03-2018 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that the alleged recovery was made from the straw house of the petitioner and not either from conscious possession or room of the house of the petitioner. The petitioner has been remanded in this case from a case, as detailed in paragraph-3 to this application, on 20.01.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Siwan Muffasil P.S. Case No.479 of 2017.
