The petitioners seek regular bail in connection with Piprakothi P.S. Case no. 53 of 2017, registered under Sections 414 /34 of the Indian Penal Code.
The case of the prosecution is that the petitioners are said to have been apprehended by the police while they started fleeing away, after leaving the tractor upon seeing the police. The learned counsel for the petitioners submits that the actual fact is that the tractor was not recovered from the house of the petitioners, but the same was recovered from the road side, from where the petitioners are said to have been apprehended by the police. Thereafter, they have been made accused in two other cases, in which, they have been falsely implicated subsequent to
Patna High Court Cr.Misc. No.33853 of 2017 (2) dt.20-07-2017 2/2 their arrest. It is further submitted that the petitioners are in custody since 05.03.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.
Accordingly, the petitioners, above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Piprakothi P.S. Case no. 53 of 2017.
