1. Heard the parties.

2. Learned counsel for the petitioner submits that the petitioner was appointed as Assistant Teacher on 11.09.1961. In 1984, the pay scale of the petitioner along with others was revised, with effect from 01.04.1981, as 2000 to 3500. The petitioner was granted senior pay scale with effect from 01.04.1993 but the revised scale applicable for senior selection grade to the extent of 7500-12000 is not being paid to the petitioner. He relied upon the seniority list, dated 14.08.2009, bearing letter No. 1102, in which the petitioner has been placed at

Patna High Court CWJC No.6352 of 2019(5) dt.18-12-2023 2/2 serial No. 3.

3. Learned counsel for the State submits that the petitioner may file a representation before the Director, Secondary Education, who will dispose the representation of the petitioner in accordance with law.

Taking into consideration the nature of dispute and the fact that the petitioner was placed at serial No. 3 in the seniority list and the senior scale had been granted to him with effect from 01.04.1993 but benefit arising of the same is not being paid, accordingly, liberty is given to the petitioner to file a written representation before the Director, Secondary Education, and if such a representation is filed, the Director shall be obliged to dispose the same, in accordance with law, by a reasoned order within a period of four months from the date of receipt/production of a copy of the representation.
