The petitioner is apprehending his arrest in connection with Bettiah Town Kalibagh (O.P.) P.S.Case no.695 of 2018 , registered for offences punishable under Sections 420, 468 of the Indian Penal Code and Section 447 of the Bihar Municipality Act, 2007.
Prosecution story as per FIR is that the petitoner has contested Municipal Election of Ward Commission on fake certificate.
Submission of the learned counsel for the petitioner is that her election has been upheld by this Court in CWJC No.8277 of 2017 and further she is ready to abide by any
Patna High Court CR. MISC. No.21340 of 2019(3) dt.21-06-2019 2/2 condition imposed upon her.
Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran, Bettiah in connection with Bettiah Town (Kalibagh O.P.) P.S.Case No.695 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition to co-operate in the investigation.
