This is an application for bail in connection with Shahkund P.S. Case No. 53 of 2017 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor girl of the informant.

Submission of learned counsel for the petitioner is that as a matter of fact the girl was eloped with the son of the petitioner and being father he has been made accused in this case and petitioner is aged 65 years. Further submission is that petitioner is ready to co-operate in investigation of case and in recovery of the girl and he is in custody for more than three months.

Having heard both sides and considering the facts and circumstances and also considering his age, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhagalpur, in connection with Shahkund P.S.Case No. 53 of 2017, subject to the conditions :- (i) One of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) Petitioner will co-operate with the police and family members of the informant in searching out the girl, otherwise his bail bond shall be cancelled.
