The petitioner seeks bail in connection with Ariari P.S. Case No. 28 of 2017, registered under Sections 341, 323, 337, 504 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 27.02.2017 at about 7.30 P.M. when informant Pintu Yadav reached near his house then saw that Nawlesh Yadav and his wife Kalwa Devi assaulting his mother and brother with bricks, when he tried to rescue, then Nawlesh Yadav ordered to kill him thereupon, his son Kanhaiya Yadav opened fire, but it passed through ear of the informant. Thereafter, he started to flee away then petitioner shot fire at him causing injury at his thigh. Learned counsel for the petitioner submits that while there is specific allegation against the petitioner to fire on right thigh of the informant, but Doctor found lacerated wound at his person

Patna High Court Cr.Misc. No.27686 of 2017 (2) dt.12-07-2017 2/2 caused by hard and blunt substance and not by fire arm. The petitioner is in custody since 28.02.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM Sheikhpura in connection with Ariari P.S. Case No. 28 of 2017. (Rajendra Kumar Mishra, J) manish/- U T
