2. Petitioners apprehend arrest in connection with Obra P.S. Case No. 470 of 2023 registered for the offences under Sections 341, 323, 383, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the instant case. Further submission is that the FIR has been lodged after a delay of two days from the alleged occurrence without any explanation for the said delay. It is also submitted that the present case is lodged to put pressure for compromise and to
Patna High Court CR. MISC. No.17246 of 2024(2) dt.02-04-2024 2/2 create defence against Aurangabad (Muffasil) P.S. Case No. 460 of 2023. The petitioners have no criminal antecedent.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of S.D.J.M., Daudnagar in connection with Obra P.S. Case No. 470 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
