ANJANA MISHRA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and learned counsel for the opposite party no. 2.
The petitioner apprehends his arrest in connection with Complaint Case No. 1058 of 2013 for the offence registered under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The petitioner and the opposite party are present in Chambers today.
After much interaction and deliberations, it has been decided that the petitioner and the opposite party no. 2 will be reunited. Petitioner, however, submits that at present, he has
been separated from other family members and there have been a partition and consequently, he is not having his own house to live him rather he is staying in the school, where he is working as Panchayat Teacher and hence, he is unable to take his wife and her son to the said place till the time he makes some arrangements for them.
In view of aforesaid facts, in the meantime, opposite party no.2 shall reside at her Maika till the arrangement for living, is made out by the petitioner and the petitioner will go and meet them as and when he gets time and opportunity to do so. Petitioner also undertakes that whenever he will get his salary in usual course after lapse of few months, he shall make substantial amount available for his wife and son so that they may also be facilitated for their daily needs with their own identity and spend their life with a high morale.
Considering the positive attitude by both the petitioner and the opposite party no. 2, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M.,
Patna City in connection with Complaint Case No. 1058 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
