JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 19.1.2017 passed in Cr.Misc.No. 51422 of 2016. Petitioner happens to be the husband and the case is under Sections 302/34 IPC.
Submission of learned counsel for the petitioner is that he is in custody since 12.5.2016 and though after trial he has been convicted under Section 306 and sentenced to undergo R.I. for five years but on appeal the case has been remanded to the trial court for proceeding afresh from the evidence stage. Heard learned APP also.
In the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, if the trial is not concluded within a period of nine months, petitioner may renew his prayer for bail.
