The petitioners are in custody in connection with Sessions Case Nos. 306/2016 and 208/2016 arising out of Beldaur P.S. Case No. 125 of 2015 for the offences under Section 397 of the Indian Penal Code and Section 27 of the Arms Act. The case was registered against unknown. The names of the petitioners surfaced on the basis of confessional statement of co-accused Chano Mandal and Dinesh Ram.
From perusal of the FIR it appears that the informant has claimed that he has seen the miscreants.
The petitioners are in custody since 30.5.2016. As
Patna High Court Cr.Misc. No.35593 of 2017 (2) dt.10-08-2017 2/2 per the statement made in para-8 of the petition no Test Identification Parade was conducted for identification of the real culprits.
Having regard to the fact that the petitioners are in custody since 30.5.2016 and they have not been put on Test Identification Parade, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 3rd, Khagaria or the successor Court in connection with Sessions Case No. 306/2016 and 208/2016 arising out of Beldaur P.S. Case No. 125 of 2015, subject to the condition that the petitioners will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
