This is an application for bail in connection with N.D.P.S. Case No. 31 of 2017, arising out of Chhauradano (Mahuawa) P.S.Case No. 54 of 2017, G.R.No. 292 of 2017, registered for the offences punishable under Sections 20(b), 11(b), 22, 23 and 24 of N.D.P.S. Act.

Allegation against the petitioner is of recovery of 5 Kg. of ganja.

Submission of learned counsel for the petitioner is that the recovered ganja is less than commercial quantity and he is in custody for five months.

Patna High Court Cr.Misc. No.39363 of 2017 (3) dt.31-08-2017 2/2 APP also.

Having heard both sides and in view of fact that the recovered article is more than small quantity, as such, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to expedite the trial and try to conclude it within nine months and if trial is not concluded within the said period, petitioner may renew his prayer for bail.
