ANJANA MISHRA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Begusarai Muffasil (Lakho) P.S. Case No. 109/2015 registered for the offence punishable under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R and only on confessional statement of co-accused namely Raghav Kumar, the petitioner's name has surfaced in the context of the present case. It is submitted on behalf of the petitioner that save and except confessional statement, there is no further material in the case diary to connect the petitioner with the present occurrence and that

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil (Lakho) P.S. Case No. 109/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Let the case diary of the present case along with supplementary diary be tagged with Cri. Misc. No. 5876 of 2016, which is a regular bail matter, may be listed before the appropriate Bench.
