In the present writ application, the petitioner has prayed for quashing the order dated 01.10.2015 passed by the House Rent Controller-cum-Sub Divisional Officer, Sadar, Madhubani in House Control Case No.3/2015, by which the application filed for rent fixation of the property being utilized by the State of Bihar, over which Madhubani police centre/line is being run, has been rejected. The petitioner has also prayed for issuance of direction upon the respondents to decide the Rent Fixation Appeal No.44/2015-16 filed under Section 24 of Bihar Building

Patna High Court CWJC No.5793 of 2019(2) dt.26-03-2019 2/2 (Lease Rent & Eviction) Control Act, 1982 preferred against the order dated 01.10.2015 passed by House Rent Controller-cumSub Divisional Officer, Sadar, Madhubani in House Control No.3/2015 within the stipulated time, which is pending before the court of Collector, Madhubani.

The petitioner confines his relief to paragraph 1(b) of the writ petition. An appeal is pending before the Respondent No.2 i.e. The Collector, Madhubani numbered as Rent Fixation Appeal No.44/2015-16 preferred under Section 24 of the Bihar Building (Lease Rent & Eviction) Control Act, 1982 against the order dated 01.10.2015 passed in connection with House Control Case No.3/2015.

Considering the aforesaid facts, the Respondent No.2 i.e. The Collector, Madhubani is directed to dispose of the appeal in accordance with law within a period of four months from the date of receipt/production of a copy of this order. With the aforesaid observation and direction, the present writ application stands disposed of.
