The petitioners have preferred this application for grant of regular bail in a case registered under sections 302, 328 and 34 of the Indian Penal Code.

As per the prosecution case, the allegations against the accused persons including the two petitioners herein, who are the father-in-law and mother-in-law of the deceased, are that ever since marriage, the sister of the informant was tortured by the accused persons and ultimately poisoned to death. It is submitted by learned counsel for the petitioners that the petitioners are the father-in-law and mother-in-law of the deceased. They are separate in residence and mess from their

Patna High Court CR. MISC. No.25160 of 2021(7) dt.14-02-2022 2/2 son, the husband of the deceased. The husband of the deceased is in custody. The petitioners are in custody since 7.12.2020 and have no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioners having remained in custody for more than 1 year, the Court directs the two petitioners to be enlarged on bail in connection with Bihiya P.S. Case no.172 of 2019 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 12th, Bhojpur at Ara.
