2. The petitioner is in custody in connection with Kalyanpur P.S Case No. 281 of 2023 registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. As per allegation in the FIR, the petitioner and other co-accused persons brutally assaulted the victim on head and other parts of body by means of axe, lathi, danda and also snatched his mobile phone.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is also
Patna High Court CR. MISC. No.14145 of 2025(2) dt.28-02-2025 2/3 submitted that petitioner is in judicial custody since 11.12.2023 and has got no criminal antecedent. It is further submitted that this is a second attempt of the petitioner of prayer for regular bail before this Court, his first prayer for regular bail was rejected by this Court vide order dated 15.04.2024 passed in Cr. Misc. No. 23262 of 2024 with following observation:- "Trial Court is directed to conclude the trial within a period of six months from the date of receipt of a copy of this order and if the trial is not concluded within the said period, then the petitioner may renew his prayer for regular bail before the trial court."
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of impugned order it appears that, there is no progress of the trial against the petitioner in light of direction of this Court. Further, it appears that investigation of this case is already concluded, accordingly, charge-sheet submitted but case is not committed to the Sessions Court till now. After considering the aforesaid facts and circumstances of the case, materials on record and

No.14145 of 2025(2) dt.28-02-2025 3/3 submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of C.J.M, Samastipur in connection with Kalyanpur P.S Case No. 281 of 2023.
