The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 448, 504, 506, 302/34 of the Indian Penal Code. The prosecutions case in nutshell is that petitioner along with co-accused persons came at the house of the informant and forcibly took out son of the informant and assaulted him. It is further alleged that petitioner and other co-accused persons caught him hold and co-accused Santosh Kumar @ Badshah stabbed the knife in the chest of the informant's son, due to which her son succumbed to injuries.

She has falsely been implicated in this case due to family dispute. There is no specific allegation of stabbing attributed against the petitioner rather specific allegation of stabbing is against co-accused Santosh Kumar @ Badshah. She has got no criminal antecedent. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused persons have already been granted bail by this Court vide order dated09.01.2023 passed in Cr. Misc. No. 44797 of 2022. The petitioner is languishing in judicial custody since 12.03.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as being a lady, this court is inclined to enlarge the petitioner on bail.
