The petitioner apprehends his arrest in connection with Complaint Case No.446 of 2017 registered under Sections 498(A) and 494/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the dispute in between the petitioner and the opposite party no.2, who are husband and wife respectively, has already been settled before the Mediation and Conciliation Centre, Patna High Court, Patna, in terms of the memorandum of agreement dated 14.10.2019, which is the part of the report dated 18.10.2019 of

Patna High Court CR. MISC. No.14653 of 2019(5) dt.21-10-2019 2/2 the Mediator of the Mediation and Conciliation Centre, Patna High Court, Patna.

Learned counsel for the opposite party no.2 submits that while the dispute in between the petitioner and the opposite party no.2 has already been settled but the petitioner is required to proceed further in terms of the memorandum of the agreement dated 14.10.2019.

Having considered the facts and the circumstances of the case and considering that the dispute in between the petitioner and the opposite party no.2 has already been settled, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, (Sadar) at Sitamarhi, in connection with Complaint Case No.C1/446 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
