JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This application, for grant of anticipatory bail, arises out of Majhaulia P.S. Case No. 364/18, disclosing offences under Sections 341, 323, 324, 307, 302, 504/34 of the Indian Penal Code.

Allegation against the petitioners and others is of assault to the father of informant, his son and on the informant also causing death of father of the informant. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and no specific allegation has been attributed to the petitioner so far assault on the father of informant is concerned and although it is alleged that petitioner no. 2 assaulted the informant, however,

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bettiah, in connection with Majhaulia P.S. Case No. 364/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
