The petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is said to have killed the son of the informant as he was having love affairs with the wife of the deceased.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case merely on suspicion. There is no eye witness of the case and no independent witnesses have supported the prosecution case. The charge in the case has

Patna High Court CR. MISC. No.13100 of 2020(4) dt.22-06-2020 2/2 already been framed. The petitioner has been languishing in custody since 25.09.2019.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty FiveThousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Uda-kishunganj, Madhepura in connection with Udakishunganj P.S.
