The petitioner seeks regular bail in connection with Excise Case No. 157 of 2019 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 51.200 liters of illicit liquor from the house of the petitioner. The learned counsel for the petitioner submits that the house in question is an abandoned house, hence the petitioner is not responsible for the recovery made therefrom. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 28.01.2019.

Having regard to the facts and circumstances of the

No. 18113 of 2019(2) dt.02-04-2019 2/2 case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 4th ADJ cum Special Judge, Bhojpur, Ara in connection with Excise Case No. 157 of 2019.
