The petitioner seeks bail in connection with G.B. Nagar P.S. Case No.333 of 2017 registered under Sections 272, 273 and 308 of the Indian Penal Code besides Sections 34, 36 and 38 of the Bihar Prohibition Excise Act, 2016.
The accusation is that on receiving secret information about manufacturing and selling of country made liquor at the Pokhari, situated at village-Diniyan, the informant alongwith other police officials reached there. On seeing the police party, two persons succeeded to flee away from there but, on search, two and half liters country made liquor, kept in a gallon, concealed in the
Patna High Court Cr.Misc. No.7284 of 2018 (2) dt.08-02-2018 2/2 grass, was recovered. The Chowkidar disclosed the name of the petitioner and one Lakshman Bin, who succeeded to flee away from there.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case and is in custody since 15.11.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge (Excise), Siwan, in connection with G.B. Nagar P.S. Case No.333 of 2017. (Rajendra Kumar Mishra, J) P.S./- U T
