JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Khaira P.S. Case No. 387 of 2018 for the offenses under Sections 395/412 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The allegation against the petitioner is that he was involved in road side robbery. The petitioner was not named in the FIR. His name surfaced on the confessional statement of the co-accused. The petitioner is in custody since 27.12.2018. Till date he has not been put on Test Identification Parade.

Considering the fact that the petitioner has no criminal antecedent and he has not been put on TIP till date, let

Patna High Court CR. MISC. No.16009 of 2019(2) dt.14-03-2019 2/2 the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 387 of 2018.
