Manglam, learned advocate for the petitioner and Mr. Upendra Pratap Singh, counsel for the State. The license of the petitioner has been cancelled by the order dated 02.03.2020.
The only ground raised on behalf of the petitioner is that no reason has been given by the authority for rejecting the explanation of the petitioner. The petitioner also regrets that he was given only three days time to represent his cause.
Patna High Court CWJC No.4501 of 2022 dt.21-06-2022 2/2 Notwithstanding such small time given to the petitioner, he responded to the notice but none of the grounds raised by him have at all been adverted to.
This is a stark case where there is complete nonapplication of mind by the authority. We cannot help but set aside the aforesaid order. The matter is remitted to the licensing authority for passing a fresh order in accordance with law after providing fresh opportunity to the petitioner to explain his cause. The order shall be passed within a period of sixty days from the date of production of a copy of this order. The petition stands allowed and disposed of accordingly.
