The petitioner seeks bail in connection with Kateya P.S. Case no. 36 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Three motorcycles borne criminals are said to have snatched the motorcycle, mobile, cash and other belongings of the informant on the point of gun.

It is submitted by the learned counsel for the petitioner that neither the petitioner is named in the F.I.R. nor any incriminating article was recovered from his conscious physical possession. There is nothing on record indicating his complicity in the occurrence barring the confessional statement of co-accused

Patna High Court Cr.Misc. No.45890 of 2017 (2) dt.19-09-2017 2/2 Golu Mishra which has no evidentiary value in the eye of law. The petitioner is languishing in custody since 12.07.2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 36 of 2017.
