JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner seeks bail in connection with Alauli P.S. Case No. 188 of 2019 instituted for the offences under Section 394 of the Indian Penal Code. The petitioner is not named in the F.I.R and his name has transpired only in the confession of co-accused persons.

The learned counsel for the petitioner has informed this Court that in the same confession of the co-accused, the petitioner's complicity was pointed out in two other cases in which also the petitioner has been made accused and about which reference has been given in paragraph No. 3 of the petition. In other cases,

Patna High Court CR. MISC. No.13196 of 2020(2) dt.03-03-2020 2/2 referred to above, the petitioner is stated to be on bail. Till date, nothing has been recovered from the possession. The petitioner has also not been put on Test Identification Parade.

The petitioner is in custody since 11.10.2019. Considering these aspects of the matter and taking into account the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S.
