The petitioner has preferred this application for grant of regular bail in a case registered under section 420/188 of the Indian Penal Code, section 7 of the Essential Commodities Act, Section 5 of Oxygen Gas Cylinder Rule of 2016, Section 9B of the Explosive Act, 1884 and Section 3 of the Epidemic Act, 1897.
As per the prosecution case, the petitioner and other co-accused persons are said to have indulged in black marketing of Oxygen gas cylinder.
Patna High Court CR. MISC. No.16022 of 2022(2) dt.20-07-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is driver of E-rickshaw and from the said E-rickshaw, one Oxygen gas cylinder was recovered. The petitioner has clean antecedent as stated at para 3 of the bail petition. Co-accused person has already been granted bail vide order dated 22.03.2022 passed by Co-ordinate Bench of this Hon'ble Court in Criminal Misc. No. 47266 of 2021. The petitioner is in custody since 11.05.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Patna, in connection with Rajiv Nagar P.S. Case No. 199 of 2021.
The application stands allowed.
