The petitioner seeks bail in a case registered for offences punishable under Section 328/304/120(B) of the Indian Penal Code and Section 50(A)(B)(C) of the Bihar Prohibition and Excise Act, 2016.

It is contended that petitioner is not named in the F.I.R. and on the basis of confessional statement of the coaccused, Lalbabu Pasi, her name has cropped up in this case and there is no recovery from the conscious possession of the petitioner. It is further contended that 11 accused persons have already been granted bail by different Co-ordinate Benches of this Court. Petitioner is in custody since 16.12.2016.

Patna High Court Cr.Misc. No.35819 of 2017(2) dt.10-08-2017 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 348/16. Further, if the petitioner, after her release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of her bail bond.
