JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 420 and 201 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

Learned counsel for the petitioners appears to be right in his submission that the name of the petitioners surfaced on the basis of statement made by the Driver of the truck loaded with fertilizer, which was intercepted by the villagers on the basis of suspicion that fertilizer was illegally manufactured. He has further submitted that the said driver has stated that one Sudarshan Poddar

Patna High Court Cr.Misc. No.19537 of 2015 (3) dt.09-07-2015 2/2 was engaged in illegal manufacturing of fertilizer and these petitioners have been implicated on the ground that Sudarshan Poddar resides in the house let out by the petitioners. The petitioners are brothers.

In view of the submission and taking into account the fact that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Falka P.S. Case No. 24 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
