Heard learned Additional Public Prosecutor for the State and learned counsel appearing on behalf of the informant.

This application, for grant of anticipatory bail, arises out of Karjain P.S. Case No.43 of 2015, disclosing offences under Sections 364, 365, 302 and 201 of the Indian Penal Code.

Considering the gravity of the offence and in

Patna High Court Cr.Misc. No.14749 of 2016 (2) dt.03-05-2016 2/2 view of the Supreme Court decision, in case of "Jai Prakash Singh vs. State of Bihar & Another", reported in (2014) 4 SCC 379, I am not inclined to entertain this application for anticipatory bail.

This application is, accordingly, rejected.

The petitioner, abovenamed, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant anticipatory bail.
