JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A, 120B and 504/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant went to the market on 02.07.2014 and thereafter, she went traceless, subsequently, the informant came to know that she was being kidnapped by the petitioner and others. It is submitted by learned counsel for the petitioner that in the certificate issued by Bihar School Examination Board, the date of birth of the victim has been recorded as 21.12.1996, hence she was major on the alleged date of occurrence. Moreover, victim appeared before the learned sessions judge at the time of hearing of bail application and admitted that she married with petitioner of her

Patna High Court Cr.Misc. No.23086 of 2015 (2) dt.17-07-2015 2/2 own and she is carrying pregnancy of three months. The said fact gets reflected from the impugned order. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Bheldi P.S. Case No. 104 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
