The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 427 and 504 of the Indian Penal Code and under Section 30(a) and 45 of the Bihar Excise Act. The learned counsel for the petitioners, at the outset, seems permission to withdraw the anticipatory bail application with respect to petitioner nos. 2 and 4 as they have been arrested
Patna High Court CR. MISC. No.17538 of 2023(2) dt.10-05-2023 2/3 during pendency of the anticipatory bail application. Learned counsel for the petitioners submits that the petitioner no. 5 is a woman and petitioner no. 1 has antecedent of one case and petitioner no. 3 and 5 are persons with clean antecedent and allegation is of recovery of 5 liters of liquor from a plastic gallon from a place behind a school. Learned counsel for the petitioners submits that the petitioners were not arrested from the spot as such nothing was recovered from their conscious possession, it is next submitted that even the alleged recovery is from a place which is accessible to public at large and the petitioners came to be implicated based on disclosure made by the local people and Chowkidar but then the name of local people is not disclosed in the F.I.R and Chowkidar in order to save the real culprits, implicated the innocent petitioners.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioner nos. 1, 3 and 5 in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees
