JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the records of this case and heard learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in Excise Case No. 786 of 2019 registered for offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2018. As per allegation, about 50 liters of illegal liquor was recovered from the Tempo, however, counsel for the petitioner submits that the petitioner is the driver of the said Tempo and he is in judicial custody since 21.12.2019 having no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down

Patna High Court CR. MISC. No.12894 of 2020(2) dt.13-05-2020 2/2 on account of pandemic Covid-19 to the satisfaction of Special Judge (Excise), Gaya in connection with Excise Case No. 786 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
