2. The following reliefs have been sought in the present writ application:

"i) For issuance of direction/ directions or order/orders or an appropriate writ/ writs particularly in the nature of certiorari for quashing the memo no. 198 dated 03.02.2026 issued under the signature of Chief Engineer-I, Patna, Rural Work Department, Patna, Chief Engineer Rural

Patna High Court CWJC No.3419 of 2026(2) dt.17-03-2026 2/3 Work Department, Patna and Superintending Engineer Rural Work Department, Work Circle, Ara whereby and where under Technical bid submitted by the petitioner in tender declared ineligible even after statutory eligibility declared by technical bid evaluation committee keeping in view of the relevant clause of eligibility as per CMBD as well as memo no. 199 dated 03.02.2026 issued under same authority whereby and where under Technical bid of Regain Const. Pvt. Ltd. (Bid ID-634801) (Petitioner's firm) in respect of Tender I.D. 1244884 has been rejected on account of difference of amount found in Civil Work and payment certificate as per financial year 2019-20 to financial year 2023-24 of ATO 26AS in the light of clause 4-7(i) of CMBD of MMGSY (AWASESH) without any explanation to the petitioner.

ii) For issuance of direction or order or writ particularly in the nature of mandamus for commanding and directing the respondents to consider the representation cum protest dated 04.02.2026 of the petitioner accordance with law. iii) For any other incidental and consequential relief to which the petitioner is found fit under the facts and circumstances of this case."

3. Upon perusal of records, it is evident that the petitioner has already made a representation before the Respondent No. 6 (Annexure-P/7 to the writ petition), which is pending consideration.

Accordingly, the Respondent No. 6 is directed to consider the aforesaid representation made by the petitioner and decide the same within a period of six weeks from the date of receipt/production of a copy of this order, in accordance with law, after giving due opportunity of hearing to all the stakeholders.

5. With the aforesaid observation and direction, the present writ petition stands disposed of.

6. Interlocutory application(s), if any, shall also stand disposed of.
