for the State and learned counsel for the B.S.F.C. (Opposite party no. 2).
The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 500 of 2019 registered under Sections 409 and 420 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that District Manager, State Food Corporation, Vaishali wrote a letter to District Magistrate, Vaishali that according to Daily Inward Excel Sheet Report, excess grain was supplied through F.C.I.
Patna High Court CR. MISC. No.13251 of 2020(8) dt.01-02-2022 2/2 and this figure is mentioned in the right side of the report, as contained in Annexure-4 to the bail application. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 500 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
