The petitioner seeks bail in Begusarai Muffasil P.S. Case No. 207 of 2017 registered under Section 25 (1-b)a/26/35 of the Arms Act.
Petitioner is said to have been apprehended with loaded country made pistol.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. Though petitioner has got some criminal antecedent but he is on bail in all the cases lodged against him.
Patna High Court Cr.Misc. No.7364 of 2018 (02) dt.07-02-2018 - 2 - From perusal of the record, it appears that the prayer for bail was rejected by the learned Sessions Judge with a liberty to renew his prayer after framing of the charge. As per the statement of the petitioner, the charge in the case has been framed. Hence, the petitioner is directed to move before the learned lower Court and the learned lower Court would dispose of the matter without being prejudice by order of this Court.
