1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Mashrak Police Station Case No. 338 of 2024, disclosing offences under Sections 341, 323, 324, 307, 34 of the Indian Penal Code.
3. As per the FIR, on 22.05.2024, in the afternoon, the nephew of the informant Shivam Kumar and his friends Yuvraj Kumar and Ankit Kumar were going to attend coaching classes and in the meanwhile, near the house of Jagjitan Sahni, all the accused persons including the petitioner, total 11 in numbers, having lathi, iron rod, sabal and knife, attacked and assaulted the nephew of the informant and his friends due to which they sustained injury.

4. Learned Counsel for the petitioner submits that both the parties are neighbors having political rivalry and election dispute. There was free fight between both the parties. The allegation against the petitioner and other accused persons altogether 11 in numbers are general and omnibus in nature and even the victim namely Yuvraj Kumar in his statement has not disclosed specific allegation against the petitioner. He next submits that similarly situated co-accused persons have been granted anticipatory bail by this Court in Cr. Misc. No. 89389 of 2024.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbors, the allegation against them is general and omnibus in nature and similarly situated co-accused persons have been granted anticipatory bail by this Court in Cr. Misc. No. 89389 of 2024, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
