JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 414 and 413 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner's name surfaced on the basis of the confessional statement of one Chandan Kumar Singh, from whose possession a stolen motorcycle was recovered. He further submits that the owner of the vehicle Om Prakash Kushwaha is, in fact, close friend of the petitioner and he had lent the said motorcycle to the petitioner. He submits that an affidavit to the effect has been filed by the said Om Prakash Kushwaha before the

Patna High Court Cr.Misc. No.19553 of 2015 (2) dt.09-07-2015 2/2 court below. It has also been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. In view of the submission as above, let the petitioner above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Khaira P.S. Case No. 113 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that the petitioner shall co-operate with the Police in course of investigation and shall present himself before the Court as and when required in connection with the said case, failing which the prosecution shall be at liberty to approach this Court for cancellation of bail.
