The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act.
It is contended that as per allegation, 360 litres of country-made liquor were recovered from the Tata Sumo vehicle which was being boarded by four persons but when they tried to escape seeing the police party two persons namely Bali Mahto and Sohan Kumar were apprehended on chase they disclosed the name of the petitioner on that basis he has been implicated in this case. Patna High Court Cr.Misc. No.34621 of 2017(2) dt.10-08-2017 2/2 who were apprehended have been granted bail by a Co-ordinate Bench of this Court vide order dated 26.04.2017 passed in Cr. Misc. No. 19127 of 2017, as contained in Annexure-2. Petitioner claims that he is having clean antecedent and is in custody since 14.06.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Gaurichak P.S. Case No. 29 of 2017 (Special Case No. 185 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
