JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Motipur P.S. Case no. 440 of 2019, registered under Sections 341, 323, 504, 307, 354 and 379/34 of the Indian Penal Code.

The accusation is that to grab the ancestral land of the informant Prabha Devi, Ajay Paswan (Petitioner No.1) started to abuse then she made protest, thereupon, Ajay Paswan, Subham Kumar, Anita Devi, Urmila Devi and Meera

No.12746 of 2020(2) dt.30-06-2020 2/2 Devi (Petitioners) started to cause assault to her and her daughter Nisha Kumari and they also torn her cloths and at that time, Subham Kumar (Petitioner No. 2) laid her daughter on the ground for the purpose of outrage her modesty. At that time, Anita Devi and Urmila Devi (Petitioner Nos. 3 and 4) snatched her gold chain.

Learned counsel for the petitioners submits that due to land dispute, hot talk exchanged between the parties, but, with ulterior motive, the present case has been lodged with false allegation. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. West Muzaffarpur in connection with Motipur P.S. Case No. 440 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
