1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Majhaulia P.S. Case No. 429 of 2020 dated 19.06.2020 registered for the offence punishable under Section 394 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that the petitioner has fair and clean antecedent and the FIR was registered against unknown persons and the petitioner has been dragged in this case merely on the basis of confessional statements of two co-accused persons namely Saif Ali and Mithun Kumar and except the confessional statements of said co-accused persons, there is no any other

Patna High Court CR. MISC. No.28001 of 2023(2) dt.24-05-2023 2/2 material to connect this petitioner to the alleged crime of loot. Further submissions are that the petitioner has been languishing in jail since 23.06.2021 and against him, the investigation has been completed.

4. Learned APP appearing for the State opposes the bail prayer.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent and his custody period and completion of the investigation against him, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Majhaulia P.S. Case No. 429 of 2020.
