The petitioner, in the present case, is seeking regular bail in Haspura P.S. Case No. 45/2017 registered under Section 820(b)(II)(A) of the NDPS Act. Learned counsel for the petitioner submits that, as per the F.I.R., 1 kg. 900 gm. Ganja has been recovered from a plastic bag said to have been in possession of this petitioner. Further, the motorcycle on which the petitioner along with the co-accused was intercepted also belonged to this petitioner. He, however, submits that there is no evidence to take a prima facie view that the bag was in possession of the present petitioner.

On the other hand, learned A.P.P. opposed the prayer for bail and submitted that the plastic bag was found in possession

Patna High Court Cr.Misc. No.38439 of 2017 (2) dt.19-08-2017 2/2 of this petitioner and, moreover, it is admitted that the motorcycle, on which the alleged 1 kg. 900 gm. Ganja was being transported, belonged to this petitioner.

In the present case, the co-accused Pawan Kumar has been granted bail by a co-ordinate bench of this Court distinguishing his case from that of the present petitioner. In the facts and circumstances, I am not inclined to grant regular bail to the petitioner in the above mentioned case. The application stands dismissed.
