JUSTICE ARUN KUMAR ORAL ORDER 02-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bakhatiyarpur PS Case No. 46 of 2018 registered under Sections 354, 354A, 456 of the IPC and Section 12 of the Pocso Act.

The allegation in brief is that in the night the petitioner was apprehended by the informant while he had entered into the room of his sister in the house and tried to indulge in molesting. Learned Counsel for the petitioner submits that there was amorous relationship between the petitioner and sister of the informant and on account of that her family members killed her for which the petitioner lodged case under Section 302 IPC against them, the police too has found the case true against the accused persons, moreover the petitioner is in custody also for approximately three months.

Having considered the said facts and circumstances, the petitioner, namely, Chitranjan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist -cum- Special Judge, Pocso Act, Patna in connection with Bakhatiyarpur PS Case No. 46 of 2018.
