JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379 and 307/34 of the Indian Penal Code and Section 3 (i) (x) (v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Learned counsel appearing on behalf of the petitioners appears to be right in his submission that no offence under Section 3 (i) (x) (v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is made out on the basis of allegation, as contained in the First Information Report, inasmuch as, no occurrence is

Learned counsel for the petitioners further submits that apparently, there is land dispute between the parties, which is genesis of institution of the present First Information Report. In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Birpur (Supaul) in connection with Nirmali P.S. Case No. 121 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
