JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Jalley P.S. Case No. 95 of 2017 registered under Sections 401, 411, 413, 414, 419, 420 and 468/34 of the Indian Penal Code.

The stolen motorcycle is said to have been recovered and seized from the possession of the petitioner which is said to have been purchased by him from Sunil Kumar.

It is submitted by learned counsel for the petitioner that the said motorcycle was purchased by him from Sunil Kumar bonafidely believing him to be the owner of the said motorcycle on his assurance that he will get his name transferred in the owner book soon. He had no knowledge of the aforesaid motorcycle to

Patna High Court Cr.Misc. No.46170 of 2017 (2) dt.21-09-2017 2/2 be stolen. He has got no criminal antecedent. He has been languishing in custody since 21.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Darbhanga in connection with Jalley P.S. Case No. 95 of 2017. Learned lower court is directed to accept the bail bond of the petitioner on verification of the criminal antecedent of the petitioner.
