The petitioner is apprehending his arrest in connection with Chandauti P.S.Case no.254 of 2018 dated 27.11.2018 , registered for offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

As per the FIR, the allegation against the petitioner is that in collusion with the Selection Committee he got his marks increased in the merit list and got himself appointed as Panchayat Teacher.

Submission of the learned counsel for the petitioner is that there is no allegation of forgery in the marks rather there is allegation of increasing marks in the merit list, which has been prepared by the Selection Committee and the petitioner

Patna High Court CR. MISC. No.21550 of 2019(2) dt.09-05-2019 2/2 has no hands in that.

Heard learned A.P.P. as well as the learned counsel for the Vigilance.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Gaya in connection with Chandauti P.S.Case no.254 of 2018 dated 27.11.2018 G.R.No.7914 of 2018 (CIS), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
