In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 147, 148, 341, 323, 324, 307, 448, 504 and 506 of the I.P.C. Allegedly, the petitioners and other co-accused being armed with Lathi, Danda and Garasa came and started assaulting the informant and his brother and when mother came for rescue then she was also assaulted by lady co-accused. Submission is of false implication and that there is case and counter case. Earlier to this case the petitioner no.3 has lodged a case bearing Khudwan P.S. Case No. 09 of 2015. All the
Patna High Court Cr.Misc. No.21168 of 2015 (2) dt.30-07-2015 2/2 injuries have been found simple in nature and as such the petitioners deserve sympathetic consideration, to which the learned A.P.P. opposes by submitting that on the head also injury has been found.
In the facts and circumstances as stated above, considering that there is case and counter case and the injuries found are simple in nature and as such the petitioners in case of their arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of.
