2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 36 litres of desi wine has been recovered from seized motorcycle.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case and nothing has been recovered from his conscious possession and has been made accused merely on the basis of suspicion.

5. Learned APP for the State opposes the bail petition and submits that petitioner carries two criminal

6. Considering the aforesaid facts and circumstances and the fact that petitioner carries two criminal antecedents of similar nature, the prayer for anticipatory bail of the petitioner is rejected.
