This is an application for bail in connection with Bhagalpur Rail P.S. Case No. 84 of 2017, registered for the offences punishable under Sections 324, 307, 120B, 302 of the Indian Penal Code and 27 of the Arms Act.
Petitioner is named in the FIR and allegation against him is of causing death of her father-in-law.
Submission of learned counsel for the petitioner is that except suspicion there is nothing against her and suspicion is based on the fact that there is property dispute between the parties from before. Further submission is that petitioner has confessed her guilt before her son that she was at fault in getting the deceased killed and she is in custody since 12.5.2017. Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that trial has commenced and one witness has been examined.

No.45783 of 2017 (4) dt.07-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, and petitioner is a lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway, Bhagalpur, in connection with Bhagalpur Rail P.S.Case No. 84 of 2017, subject to the conditions as follows :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, her bail bond shall be cancelled.
