The petitioner seeks bail in a case registered under Sections 420, 409, 467, 468, 471, 472, 120(B)/34 of the I.P.C. Allegation is that the accused persons committed forgery and cheating of government money.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The main allegation is against co-accused Jai Kishun Tiwari,

Patna High Court CR. MISC. No.15451 of 2019(3) dt.10-05-2019 2/2 who alleged to have caused wrongful loss and wrongful gain on his part. Rs.1,30,00,000/- is said to have been recovered from the possession of co-accused and his other properties have also been identified to be attached. So far the petitioner is concerned, no wrongful loss or wrongful gain has been made on his part. Other co-accused has been granted bial vide Cr.Misc.No.9660 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. case No.824 of 2018.
