JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and perused the case diary. The petitioner is in custody in a case registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code.

Allegedly, it is a case of recovery of stolen motorcycle from this petitioner and petitioner could not explain to the police that the said motorcycle is a stolen one.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only on the basis of mere suspicion. Petitioner is in custody since 20.09.2021.

Learned APP appearing for the State has opposed the prayer for regular bail and submitted that the seizure list shows

Patna High Court CR. MISC. No.15882 of 2022(3) dt.03-01-2023 2/2 that the Passionpro motorcycle was recovered from the conscious possession of the petitioner at the time of his arrest. The petitioner has criminal antecedent in six cases. After considering the aforesaid facts, I am not inclined to grant regular bail to the petitioner. Prayer for regular bail of the petitioner is hereby rejected.

However, the court below is directed to expedite the trial expeditiously within a period of six months and if the trial is not concluded within the stipulated period, the petitioner will be at liberty to renew his prayer for bail.
